AGREEMENT TO TENDER AND ACCEPT

a. If payment is accepted after entry of Judgment, unless otherwise provided herein, landlord may obtain and have served/executed a Writ of Restitution five calendar days after entry of Judgment.

b. Acceptance of the partial payment does not effect a waiver (express or implied) of the “Time of the Essence” provision of your Rental Agreement. Partial payments shall be applied as follows: first, to legal fees and court costs, then to accrued interest on any amounts owed to the landlord, then to late fees, then to amounts owed for damages to the property, then to any other amounts owed by the tenant to the landlord, then to unpaid past due rent, and finally to prepaid rent.

c. Upon default hereof by tenant, Landlord may proceed with legal action to recover past rent, damages, possession of the leased premises or any other relief permissible by law or under the rental agreement.

d. If previously served with a “Notice to Pay or Quit,” acceptance by the Landlord of this partial rent payment WILL NOT restart the time running for compliance and, pursuant to A.R.S. § 33-1371(B), no additional notice under A.R.S. § 33-1368(B) shall be required.

NOTICE OF ABANDONMENT

[ ] Personal Property Present. You have been absent from the leased premises, without notice to the landlord, for at least seven days and rent is outstanding and unpaid for at least ten days. There is no reasonable evidence that you are occupying the leased premises, except for the presence of some personal property within the leased premises. Consequently, pursuant to Arizona Revised Statutes, Title 33, Chapter 10, Section 33-1370, you are hereby tendered written notice that the landlord deems the leased premises to be “abandoned,” as that term is defined by A.R.S. § 33-1370(H).

[ ] No Personal Property Present. You have been absent from the leased premises, without notice to the landlord, for at least five days and rent is outstanding and unpaid for at least five days, and none of your personal property remains within the leased premises. Consequently, pursuant to Arizona Revised Statutes, Title 33, Chapter 10, Section 33-1370, you are hereby tendered written notice that the landlord deems the leased premises to be “abandoned,” as that term is defined by A.R.S. § 33-1370(H).

Unless you contact the landlord, the landlord shall enter and retake possession of the leased premises five days after this notice has been: (1) posted on the door to the leased premises or some other conspicuous spot and (2) mailed via certified mail, return receipt requested, to your last known address and any alternate addresses known to the landlord. Any personal property remaining on or in the leased premises shall be handled in accordance with A.R.S. § 33-1370. To prevent loss of possession of the leased premises, contact:
